Is CBD Oil Legal At All

CBD oil sales across the US picked up following 2014’s Farm Bill, and after 2018’s version of the Bill, the floodgates really opened. You’d think this would be a sure sign of CBD oil’s legality…but no. 

Basically, CBD oil is only legal if it’s derived from “industrial hemp” that contains less than .3% THC by dry weight. CBD derived from cannabis is federally illegal, and so are synthetic cannabinoids. 

Some states put additional restrictions on their CBD. Connecticut has banned CBD produced with butane, a potentially toxic solvent; other states are expected to follow suit. In Indiana, all retail CBD products must come labelled with a scannable QR code linked to lab tests. And in Idaho, there are even more restrictions…

Is CBD Oil Legal in Idaho? 2020 Updates

Is CBD oil legal in Idaho? The short answer is yes! 

But it’s not so simple. For CBD products to be legal in Idaho they must be 100% THC free, so basically either Broad Spectrum or CBD isolate.  The federally-mandated <.3% standard just doesn’t cut it! Here’s the state’s policy in their own words: “First, the oil extract cannot contain ‘any quantity’ of THC — not just less than .3%. Second, the oil extract cannot be deemed ‘marijuana’ under Idaho Code §37-2701.”

And that’s not all. To be permitted in Idaho CBD products must also come from certain parts of the hemp plant: “a) mature stalks of the plant, (b) fiber produced from the stalks, (c) oil or cake made from the seeds or the achene of such plant, (d) any other compound, manufacture, salt, derivative, mixture, or preparation of the mature stalks, or (e) the sterilized seed of such plant which is incapable of germination.”

In other words, CBD manufacturers can’t get their CBD from hemp’s highly resinous flowers. It has to come from the less resinous, more fibrous parts of the plant! 

This policy might be well-intentioned — but it has some blind spots. Because the above methods necessitate using more hemp material to produce the very same amount of CBD, they’re likely to produce concentrates high in residual pesticides and solvents. It’s worth noting that California takes an opposite (and better!) approach, requiring some cannabis products to be derived from the plant’s most resinous parts.

Idaho’s Industrial Hemp Bill

While Idaho’s current policies can be troublesome, their future looks a little better. 

Why? Because a bill to legalize hemp farming (the state is currently one of just three that still outlaw it) could be signed into law later this year. “I’m fine with hemp so long as it’s not camouflaged for marijuana,” governer Brad Little told The Idaho Statesman. This bill would likely mirror existing federal bills and make provisions for the growing, testing, and processing of hemp by state farmers. It would also establish a statewide database of licensed growers. The bill has faced opposition by several lawmakers who fear it will make anti-marijuana laws unenforceable. Let’s hope it still passes! 

In the meantime, some good news: Idahoans can still use CBD so long as they opt for broad spectrum or CBD isolate products! While Idaho’s laws may seem like a burden, they might just make known quality standards — like independent lab testing and labelling transparency — even more important. There are other important standards, too.
